Access pursuant to § 3a of the Administrative Procedures Act (Verwaltungsverfahrensgesetz: VwVfG)

With its virtual post office, the City of Osnabrück offers its citizens and public and private corporate bodies the possibility of safe, legally binding electronic communication.

For the area governed by administrative procedures, electronic communication complies with § 3a of the Administrative Procedures Act (VwVfG) in conjunction with § 1 section 1 of the Lower Saxony Administrative Procedures Act (Niedersächsisches Verwaltungsverfahrensgesetz: Nds. VwVfG). In accordance with these acts, the transfer of electronic documents is permissible insofar as the recipient has established access for doing so. The equivalent applies in civil law pursuant to § 126a of the German Civil Code (Bürgerliches Gesetzbuch: BGB).

The City of Osnabrück establishes this access according to the requirements of the framework conditions that apply exclusively to communication with the City of Osnabrück and not to third parties (linked establishments, other authorities, tax offices, and so on).

Suitability for the disabled

This website is designed to be suitable for the disabled to the greatest possible extent. The regulations governing information technology suitable for the disabled according to the Information Technology Suitable for the Disabled Decree (Barrierefreie Informationstechnik-Verordnung: BITV) have been realised. Since, however, technical modules such as a geographic information system (see city map or zoning map) have been included that have not been constructed with suitability for the disabled in mind, there are a few areas that may not be accessible to the handicapped. Not only does the City of Osnabrück provide an environment that is suitable for the disabled to the greatest possible extent, it also supplies information on the suitability of municipal buildings for the disabled. The City of Osnabrück was supported in the realisation of these measures by WEB for ALL (www.webforall.info) as well as the Osnabrück Forum for the Disabled (Behindertenforum Osnabrück).

The photos and pictures originate from the picture library of the Press and Information Office or from the individual departments’ sources. Photos taken from the picture libraries PhotoCase and Pixelio, which are freely available on the web, have also been implemented.

Intellectual property rights of the geodata

Geodata are copyrighted and protected against exploitation (the relevant versions of the German Copyright Act: Urheberrechtsgesetz [UrhG] from 9 September 1965 and the Act Against Unfair Practices (Gesetz gegen den unlauteren Wettbewerb) from 7 June 1909). In the case of cartographic data (§ 2 Number 7 of the UrhG), copyright refers to the type of portrayal. Aerial views are also protected (§ 72 of the UrhG).

Nearly all of the available digital geodata are also contained in databases that are subject to protection against exploitation pursuant to § 87a ff. of the UrhG. This protection also extends to data that are automatically visualised.

The data available via Osnabrück zoning map may only be freely used within the framework stipulated by the German Copyright Act. The production of single duplicates for private use is permissible pursuant to § 53 of the UrhG.

Ordinary right of use and enjoyment must be requested for any further use (§ 31 of the UrhG). Above all, this applies to the publication, dissemination and commercial use of protected data.
